Workforce Restructuring Report

Purpose

The report (1) responds to the requirements of Section 3161 to provide Congress with the results of work force restructuring at the Department of Energy (DOE) defense and other designated sites; and (2) is used to assist the DOE in evaluating the reasonableness and effectiveness of the work force restructuring at each site to ensure mission requirements are met, while minimizing the social and economic impacts of restructuring on both workers and communities.

Coverage

Report employees filling positions identified as full-time status or part-time status on the Subcontractor’s approved staffing plan. Employees filling those positions who were transitioned or assigned from any other source (company transfer or new hire) should be counted. Employees filling intermittent or temporary positions on the Subcontractor’s approved staffing plan should not be counted. Part-time refers to an employee’s status (i.e., employee works less than 40 hours per week), intermittent refers to the fact that the position is filled by your company less than 1000 hours per year and has been exempted from workforce transition on the staffing plan.

Frequency

Annual (FY) – Reporting period ends September 30.

Due Date

Subcontractors must submit the report by the 10th day following the close of each reporting period. This report should be submitted via email or fax to:

Instructions

I.  Site Information

  1. Field/Operations Office Enter "ORO"
  2. Site Choose one of the following from the pull down list, Oak Ridge, TN, Paducah, KY or Portsmouth, OH.
  3. Team Enter the company name as used in the subcontract.
  4. Defense/Non-Defense Enter "D" (Defense).
  5. Report Period Choose the appropriate reporting period from the pull down list.

II. Separations and Costs

All data should reflect actual separations occurring within the reported fiscal year, regardless of the date of a plan under which the employees separated. Number of employees (workers) should reflect a headcount. The cost should be reported in whole dollar amounts only (no decimals). Enter only the cost that is paid by the employer and reimbursable by the Department of Energy

Voluntary Separations

Early Retirement
  1. Workers Enter the number of employees working on the respective contract who separated through an approved early retirement incentive program. Do not include individuals separated through normal retirement (and receiving company retirement benefits.)
  2. Cost Enter the net present value of the full value actuarial liability of the incentive package for all employees separated during reporting year and accepting the program.
Non-Retirement Voluntary Separations

  1. Workers Enter the number of employees working on the respective contract who separated through an approved non-retirement voluntary separation program.
  2. Cost Enter the amount of the benefits provided in the incentive package (e.g., cash payments, including any contracted severance pay) for all employees separated during the reporting year and accepting the program. Report only the benefits of the package. Do not report costs associated with other benefits that may be provided (e.g., medical benefits, education, relocation, and outplacement). Accrued vacation and sick leave costs should not be included.
Net Positions Reduced Through Attrition
  1. Workers Enter the number of employees working on the respective contract who separated on a voluntary basis other than an early retirement or non-retirement voluntary separation program, minus the number of new hires on the respective subcontract. This category includes separations because an employee quits, dies, leaves for cause, leaves on permanent disability or takes normal retirement. It does not include employees who are outsourced. New hires are to include both hires through preference-in-hiring and new hires not through preference-in-hiring. In the event that hires exceed separations, enter zero.
  2. Cost This amount is normally zero. Extraordinary costs, such as plant closing costs, may be reported after consultation and approval by the Office of Worker and Community Transition
Involuntary Separations With Benefits Non-Construction Workers
  1. Workers Enter the number of employees working on the respective contract who separated through an approved involuntary separation program.
  2. Cost Enter the amount of benefits provided in the separation package, including normal and incentivized severance. Report only the benefits of the package. Do not include payment sin lieu of notice, wages and benefits paid during the notice period, or unemployment compensation. Do not report costs of other benefits that may be provided (e.g., medical benefits, education, relocation, and outplacement).
With Benefits - Construction Workers
  1. Workers Enter the number of employees working on the respective contract who separated through an approved involuntary separation program, and who received an approved one-time construction worker benefit.
  2. Cost Enter the amount of benefits provided in the separation package, including the one-time cash payment. Report only the benefits of the package. Do not include payments in lieu of notice, wages and benefits paid during the notice period, or unemployment compensation. Do not report costs of other benefits that may be provided (e.g., medical benefits, education, relocation, and outplacement).

Without Benefits

  1. Workers Enter the number of involuntary separated employees working on the respective contract that were not eligible to receive work force restructuring benefits (other than possible company-related benefits). Include construction workers not eligible for the one-time payment and any temporary or part-time personnel. Do not include any personnel that have been brought on site since the last reporting period and have separated prior to the current reporting period.
  2. Cost There is no associated cost.
Remaining Affected Workers
  1. Workers Internally Placed Without Retraining
    1. Workers Enter the number of employees working on the respective contract that transferred within, or found new employment at the same site with the same firm, and required no additional training to fill the new position. Include only those employees who otherwise would have been susceptible to separation due to work force restructuring activities. Do not include employees placed through outsourcing.
    2. Cost This amount is normally zero. Consult with the Office of Community and Worker Transition regarding any costs over and above normal costs of placing workers in other positions.
  2. Workers Internally Placed Through Retraining
    1. Workers Enter the number of employees working on the respective contract that transferred within, or found new employment, at the same site with the same firm, as a result of retraining efforts and expenditures. Include only those employees who otherwise would have been susceptible to separation due to work force restructuring activities. Do not include employees placed through outsourcing. Training can have been provided either before or after placement in the new job.
    2. Cost Enter the incremental cost of retraining borne by the Department of Energy (e.g., tuition and materials). Include the incremental cost of instructors' salaries that are directly related to the provision of training. Do not include the trainees' salaries while enrolled. Do not include costs of retraining that are otherwise funded (e.g., JTPA funding).
  3. Transfer to Other Sites
    1. Workers Enter the number of employees working on the respective contract who found employment at another DOE site, regardless of whether the employees remain with the same employer, and who did not receive DOE funded restructuring related assistance. Do not include employees who were separated voluntarily or involuntarily under an approved separation program.
    2. Cost There is no associated cost.
     

Other Benefits Provided

  1. Displaced Worker Medical Benefits
    1. Workers Enter the number of displaced employees working on the respective contract who, during the fiscal year being reported, received displaced workers medical benefits associated with their approved separation program. (A displaced employee may receive these benefits over several years; he/she is to be counted in each year the benefits are received.
    2. Cost Enter the cost of providing these benefits during the fiscal year being reported.
    3. Relocation Assistance
      1. Workers Enter the number of employees working on the respective contract who, during the fiscal year being reported, received an approved relocation assistance incentive associated with their approved separation program. This may include relocation assistance connected with intra- and inter-firm transfers to other sites, if funded through an approved restructuring plan.
      2. Cost Enter the cost of providing these benefits during the fiscal year being reported. The cost of providing these benefits has two components, as follows: (a) For outplacement services used by employees working on the respective subcontract and who were impacted by work force restructuring, count all costs of internal and external programs. (b) For outplacement services open to the site-wide population, count only that portion of the costs associated restructuring plan activities. There should be no other costs associated with this benefit.
      3. Education Assistance
        1. Workers Enter the total number of separated employees working on the respective contract who, during the fiscal year being reported, utilized an approved education assistance program. (A separated employee may utilize these benefits over several years; he/she is counted in each year the benefits are used.)
        2. Cost Enter the cost of providing these benefits during the fiscal year being reported. Costs include expenses such as tuition and materials. Do not report costs associated with Subcontractor-sponsored tuition reimbursement programs.
      4. Other Separations
        1. Workers Enter the number of subcontractor employees that have voluntarily separated as a result of work force restructuring where the costs due to these separations, including severance, have been incurred by the management team, either under a subcontract or under a labor agreement. Do not include any temporary or part-time workers or employees of vendors who have been separated as a result of work force restructuring. Also do not include subcontract employees separated due to normal termination of their contract or whose work ends for any reason other than a work force restructuring action.
        2. Cost Enter the cost incurred by the employee working on the respective contract, due to these separations.
      5. Involuntarily Separated
        1. Workers Enter the number of subcontractor employees that have involuntarily separated as a result of work force restructuring where the costs due to these separations, including severance, have been incurred by the management team, either under a subcontract or under a labor agreement. Do not include any temporary or part-time workers or employees of vendors who have been involuntarily separated as a result of work force restructuring. Also do not include subcontract employees involuntarily separated due to normal termination of their contract or whose work ends for any reason other than a workforce restructuring action.
        2. Cost Enter the cost incurred by the members of the management team working on the respective contract, due to these separations.
      Other Information
      1. Net Positions Reduced Through Outsourcing Enter the net number of employee positions, from the respective contract, eliminated during the reporting period as a result of outsourcing work associated with those positions. This is to equal the difference between the number of positions needed to perform the same scope of work after outsourcing. (Example: Employees performing work prior to outsourcing: 50. Employees performing the same work after outsourcing: 40. Number to be entered: 10.)
      2. New hires Not Through Preference-In-Hiring Enter the number of employees hired during the reporting period to permanent positions, on the respective contract, for reasons other than their preference-in-hiring status.
      3. Backfills Enter the number of positions on the respective contract where: (1) an individual was separated through a voluntary non-retirement program (not by attrition) or an involuntary program, and (2) the position was retained and subsequently filled by another employee during the reporting period.
      4. Rehires Enter the number of employees working on the respective contract separated through either a voluntary or involuntary separation program and subsequently hired back during the reporting period by any management team member at the site, regardless of the work to be performed.
      5. Hire Through Preference-In-Hiring Enter the number of employees working on the respective subcontract during the reporting period, hired to permanent positions as a result of their preference-in-hiring under an approved work force restructuring plan.
      6. Employees Eligible for Preference-In-Hiring Enter the total number of employees working on the respective subcontract who, during the reporting period, were eligible for preference-in-hiring under an approved work force restructuring plan.
      7. Comments Provide any information on the methodology used to determine the data reported if this methodology is not in conformity with these instructions. Provide line item identifiers.
